What is the procedure to begin transfer of shares?
First step is to identify all next of kin. Family members need to fill out and return a Relatives of Deceased Form and submit a copy of a Death Certificate or a copy of a printed Obituary. We need to verify that the deceased shareholder does not have a newer version stock will or formal will on file outside of TAC.
What happens if the deceased had stock in the Corporation and did not have a Stock Will on file?
If a Stock Will or formal Will does not exist, the deceased shareholder’s stock will pass to the heirs by intestate succession according to Alaska State law. The procedure of intestate succession is as follows:
· The spouse will receive 100% of the shares if there are no surviving children, grandchildren, or great-grandchildren (legally referred to as “surviving issue”).
· If there are surviving issue the spouse will receive 50% and the remaining 50% will go to the surviving issue.
· The stock is divided equally among the surviving issue if there is no surviving spouse.
· Surviving parents of the deceased will receive the stock if there are no surviving issue.
· Surviving brothers and sisters will receive the stock if there are no surviving spouse, surviving issue, or surviving parents.
· Surviving nieces and nephews will receive the stock if there are no other survivors as listed above.
I see several names that I recognize, what can I do to help find the rightful heirs?
Any help is greatly appreciated. We need addresses or contact information for next of kin. Give TAC any contact information, or ask the next of kin to contact TAC directly. Most importantly we need forms returned in order to proceed, such as Relatives of Deceased Forms (attached) completed and returned and Affidavit of Entitlements completed and Returned.
Many of the deceased shareholders from years ago, may now have deceased eligible heirs, and TAC needs to contact their heirs as well, because the system just branches out. We need your help in identifying the family tree of those shareholders that passed away long ago, so we can locate and finalize the transfer their shares.
